By using the website at palmdesertfence.com, requesting an estimate, or engaging PD Palm Desert Fence to perform any services, you agree to be bound by these Terms and Conditions. If you do not agree, do not use this Site or our services. We reserve the right to update these terms at any time, with changes taking effect upon posting to the Site.
PD Palm Desert Fence provides residential and commercial fence installation, repair, replacement, and related services in Palm Desert, CA and the surrounding Coachella Valley area. Services are performed by licensed and insured contractors.
We reserve the right to decline any project at our discretion, including projects that do not meet our safety standards, that involve work outside our service area, or that require permits or approvals we are unable to obtain.
All estimates provided by PD Palm Desert Fence are based on information available at the time of the site visit or inquiry. Estimates are not final quotes until confirmed in writing. Final pricing may differ from an initial estimate if site conditions, material costs, or project scope change after the estimate is issued.
Any additional work beyond the agreed scope will be discussed and priced separately before proceeding. We will not perform out-of-scope work without your prior approval.
Many fence installations in Palm Desert require a building permit from the City and, in HOA-governed communities, written approval from the homeowners association. Where applicable, we will assist with permit applications as part of our service. However, it is the customer's responsibility to obtain all required HOA approvals before work begins.
PD Palm Desert Fence is not liable for delays, fines, or required removals resulting from a customer's failure to obtain required HOA approval before project commencement.
Once a start date is scheduled, we ask that you provide at least 48 hours notice if you need to reschedule. Cancellations made after materials have been ordered or work has commenced may result in charges to cover material and labor costs already incurred.
We make every effort to complete projects on the scheduled timeline. Delays caused by weather, permit processing, utility marking, or other factors outside our control do not constitute a breach of our agreement.
Payment terms are outlined in the written project agreement provided before work begins. A deposit may be required to secure materials and schedule your project. The remaining balance is due upon completion of work unless otherwise agreed in writing.
Overdue balances may be subject to late fees as specified in the project agreement. PD Palm Desert Fence reserves the right to suspend or terminate work on any project with an outstanding overdue balance.
PD Palm Desert Fence warrants that all labor will be performed in a workmanlike manner consistent with industry standards. Any warranty on labor will be specified in the written project agreement. Material warranties are subject to the terms provided by the respective manufacturer.
Warranties do not cover damage caused by acts of nature (including high winds, flooding, or seismic events), vandalism, misuse, improper maintenance, or modifications made by anyone other thanPD Palm Desert Fence after project completion.
To the fullest extent permitted by law, PD Palm Desert Fence shall not be liable for any indirect, incidental, special, or consequential damages arising from our services or your use of this Site, including but not limited to loss of use, loss of revenue, or property damage not directly caused by our negligence.
Our total liability for any claim related to services performed shall not exceed the total amount paid by the customer for those specific services.
You agree to provide accurate information about your property and project needs. You are responsible for ensuring clear access to the work area and for informing us of any known underground utilities, irrigation systems, or other obstacles not visible from the surface.
If underground utilities or structures are encountered that were not disclosed and cause additional work or delay, any resulting costs will be discussed with you before we proceed.
If a dispute arises between you and PD Palm Desert Fence, we ask that you contact us directly at sales@palmdesertfence.com so we can work toward a resolution in good faith.
If we are unable to resolve a dispute informally, the parties agree to submit to binding arbitration in Palm Desert, CA under the rules of the American Arbitration Association, except where prohibited by law. Class action claims are waived to the fullest extent permitted by applicable law.
These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought in the appropriate courts of California.
You may use this Site only for lawful purposes. You agree not to use the Site in any way that could damage, disable, or impair its functionality, or interfere with other users. Unauthorized use of the Site or its content is prohibited.
